Estate Mediation

Disputes over estates can be stressful, emotional and deeply personal. They often involve family members, grief, anger, resentment, fear or confusion — especially when there are concerns about a Will, inheritance, estate distribution or the wishes of a loved one.

Estate Mediation provides a calm, respectful and non-confrontational way to talk through difficult issues with the help of an independent Mediator. It can help families avoid the stress, cost and damage that often comes with legal disputes and court proceedings.

At Australian Mediation, our experienced Mediators help guide important conversations so each person can be heard, better understand the issues, and work towards a practical agreement, or at least provide a clearer understanding of why a decision has been made.

When can Estate Mediation help?

Estate disputes may arise after the death of a loved one, or during estate planning. Disagreements often occur when family members have different views about the person’s wishes, the terms of a Will, or how assets should be distributed.

Estate Mediation may assist with:

  • Property and estate distribution
  • Claims against an estate
  • Contesting or challenging a Will
  • Questions about capacity or undue influence
  • Concerns about the validity of a Will
  • Disputes about an Executor or how an estate is being managed

This list is not exhaustive. If you are unsure whether your matter is suitable for mediation, speak with our friendly Client Services team.

Important note: Australian Mediation does not provide legal or financial advice. We encourage participants to seek independent and suitably qualified advice before attending a joint mediation session.

Is my matter suitable for Estate Mediation?

Many estate disputes are suitable for mediation, including matters involving high conflict, difficult family dynamics or concerns about safety. Where needed, mediation can be arranged by phone or video using Zoom, Microsoft Teams or similar platforms.

Sessions can also be structured so parties do not need to see or hear each other, with the Mediator instead going between parties and assisting with a near live discussion, with far less of the emotional stress.

Your Australian Mediation Mediator will assess whether your matter is appropriate during the Intake and Assessment stage, and under what format (i,.e., direct or no direct coice contact etc). The safety, comfort and wellbeing of all participants is always the priority.

What if the other party refuses to mediate?

If the other party does not wish to take part, you may still be able to request a letter confirming that mediation was attempted. A fee may apply.

You may also choose to meet individually with one of our Mediators to prepare an Estate Proposal. This can help you clearly outline your preferred outcome and may be provided to the other party or used as a starting point for legal discussions.

Who can start Estate Mediation?

Anyone involved in an estate dispute can start the mediation process.

You can tell the other party you would like to begin Estate Mediation, or Australian Mediation can contact them as part of our formal process. Some clients prefer to raise mediation directly, while others prefer to reduce contact and have us assist.

Our Client Services team can talk you through the best option for your situation.

Is Estate Mediation expensive?

Estate Mediation is often a much more affordable way to resolve disputes compared with lengthy legal negotiations or court proceedings.

Australian Mediation provides a private, streamlined and cost-effective mediation process. Our pricing is generally less than half the hourly rate of many legal and financial advisers. The more issues you resolve through mediation, the more you may save in legal fees and court costs.

What is the process and how much does Estate Mediation cost?

The first step is for one party to complete their individual Intake & Assessment session, and this costs $320.00.  At the end of this session we will contact and invite the other party to the mediation process (this session will also cost $320.00).  Once the Mediator advises it is appropriate to continue, and under what format (direct voice etc), we can then schedule a joint Estate Mediation session.  The joist session is charged at $220.00 per hour per party.

What Is a Facilitated Conversation?

Sometimes there is no formal dispute, but an important or difficult conversation still needs to happen.

A facilitated conversation is different from mediation. Mediation is usually used to resolve a dispute. A facilitated conversation helps people share information, understand each other’s views, and talk through sensitive issues in a structured and respectful way.

This can be useful when someone needs support to explain a difficult decision to family members, friends or loved ones.

Facilitated conversations may assist with:

  • Medical treatment decisions
  • Personal care arrangements
  • Accommodation needs
  • Palliative care options
  • End-of-life decisions

Australian Mediation provides a safe and balanced space where everyone has uninterrupted time to speak, ask questions and gain clarity.
